Public Path Creation Order 2022 - Footpath to the rear and east of Brookfield and footpath link from Heol Glynderwen to Caf Y Felln

Notice of Confirmation of Public Path Creation Order

On the 6th September 2022 the Council of the County Borough of Neath Port Talbot confirmed the above Order made under Section 26 of the Highways Act 1980.

The effect of the order as confirmed is to divert the public footpath running from a point on the east west length of footpath no.4, some 9 metres north of house no 53 ( grid ref SS 740983) and curving in a generally south westerly and southerly direction for 155 metres before turning in an east south easterly direction for 33 metres to pass alongside the playground and then to join Heol Glynderwen.( grid ref SS 740981)

In addition that length of footpath commencing on Heol Gynderwen some 35 metres south of the last mentioned point and proceeding in a generally westerly direction for 45 metres before turning in a southerly direction for 15 metres to join the path which passes between house no.s 69 and 71 at the cul de sac of Caf y Felln.

A copy of the Order as confirmed and the Order Map have been placed and may be seen free of charge at the offices of  Neath Port Talbot County Borough Council  Civic Centre,  Port Talbot between 10.00 a.m. and 4.00 p.m. Mondays to Fridays.

The Order comes into force on the 6th September 2022 but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the power of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may under paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within 6 weeks from 30thSeptember 2022 make an application to the High Court

Public Path Creation Order

The Order is made by the Council of the County Borough of Neath Port Talbot ("the Authority") under Section 26 of the Highways Act 1980 ("the 1980 Act") because it appears to the Authority that having regard to the matters set out in Section 26(1) there is a need for a public bridleway over the land to which this Order relates, and that it is expedient that the way should be created.

The Community Council of Blaenhonddan has been consulted as required by Section 26(3) of the 1980 Act.

BY THIS ORDER

  1. There shall be at the end of 28- days from the date of confirmation of this Order a public footpath over the land described in Part 1 of the Schedule to this Order and shown by a broken line on the map attached to this Order

Schedule

Part 1 - Description of land

That length of footpath commencing at point A and proceeding in a generally south south westerly direction for 40 metres or thereabouts to point B before proceeding in a southerly direction for 115 metres to point C thence in an east south easterly direction for 33 metres to point D .

Also that length of footpath commencing at point E and proceeding in a westerly direction for 45 metres to point F before proceeding in a southerly direction for 15 metres to point G.

All distances and directions are approximate.

Length of path A-D = 188 metres and E-G = 60 metres, both paths being 1.5 metres wide.

Public Path Extinguishment Order 2022 - Part of Footpath No. 4, from the rear of Brookfield to Taillwyd Road

Notice of Confirmation of Extinguishment Order

On the 6th September 2022 the Council of the County Borough of Neath Port Talbot confirmed the above Order made under Section 118 of the Highways Act 1980.

The effect of the order as confirmed is to extinguish  that length of public footpath no.4 running from a point commencing at a point situated to the rear of house no.109 and 110 Brookfield ( grid ref SS740983) and proceeding in a predominantly south south westerly direction for 500 metres to join Taillwyd Road opposite house no.45 ( grid ref SS 738978).

A copy of the Order as confirmed and the Order Map have been placed and may be seen free of charge at the offices of Neath Port Talbot County Borough Council  Civic Centre,  Port Talbot between 10.00 a.m. and 4.00 p.m. Mondays to Fridays.

A copy of the order may also be obtained by visiting the Council website.

Public Path Extinguishment Order 2022

The Order is made by the Neath Port Talbot County Borough Council ("the Authority") under Section 118 of the Highways Act 1980 ("the 1980 Act") because it appears to the Authority that the footpath described in paragraph 1 below is not needed for public use.

By this order

  1. The public right of way over the land situated predominantly to the rear and east of Brookfield and shown by a bold continuous line on the map attached to this order and described in the Schedule to this order shall be extinguished after 28 days form the date of confirmation of this Order.

Schedule

That length of path commencing at point A (Grid reference SS 740983) and proceeding in a south south westerly direction for 500 metres to point B (Grid ref SS 738983).

All distances and directions are approximate.

Length of the path = 500 metres

Width of the path = 1.5 metres

Community of Ystalyfera Modification Order No. 1/19 2019

Notice of Confirmation of Modification Order

On the 4th August 2022 the Inspector appointed by the Welsh Ministers confirmed the above named order.

The effect of the Order is to modify the Definitive Map and Statement for the area by adding that length of footpath commencing on Y Gilfach (grid ref SN 876093) and proceeding in a generally south south easterly direction for 75 metres before continuing in a south easterly direction for 115 metres to join the access lane to the rear of Clare Road before bearing in a south south westerly direction for 110 metres and then continuing in a south easterly direction for 50 metres to join Clare Road (grid ref SN 766090).

A copy of the Order and Order map may be seen free of charge at the offices of Neath Port Talbot County Borough Council, Civic Centre, Port Talbot between 10.00am and 4.00pm Mondays to Fridays.

The Order became operative as from the 4th August 2022 but if a person aggrieved by the order desires to question its validity on the grounds that it is not within the powers of Section 53 or 54 or that any of the requirements of Schedule 15 have not been complied with in relation to the Order, they may, within 42 days from the date of the publication of this Notice make an application to the High Court.

Public Path Extinguishment Order 2022 - Community of Ystalyfera - Footpath No.233 from Maengwyn to Cwmdu Road

The above Order made on the  10th  November 2022 under Section 118 of the Highways Act 1980 will extinguish  the public footpath no.233 running from a point opposite house no. 12 on Maengwyn Road ( grid ref SN 740062) and proceeding in a generally southerly direction  for 106 metres  to join the footway at the junction of Cwmdu Road and Pencwmdu  ( grid ref SN 740061 )

A copy of the Order and the Order Map  may be seen free of charge from the offices of the Neath Port Talbot County Borough Council.

As the Council offices are closed a copy of the order may be obtained by visiting the Council website.

Any representations about or objections to the Order may be sent in writing to the Head of Legal and Democratic  Services, Civic Centre, Port Talbot no later than the 20th December, 2022 and should state the grounds on which they are made. if no representations or objections are duly made or if any so made are withdrawn Neath Port Talbot County Borough Council may confirm the Order as an unopposed Order.  If the Order is sent to the Welsh Ministers for confirmation, any representations and objections which have not been withdrawn will be sent with the Order.

By this Order

  1. The public right of way over the land situated between Maengwyn and Cwmdu Road shown by a bold continuous line on the map attached to this order and described in the Schedule to this order shall be extinguished after 28 days from the date of confirmation of this Order.

Schedule

That length of path commencing at point A (Grid reference SN 740062) and proceeding in a south south westerly direction for 48 metres to point B before continuing in a south south easterly direction for 32 metres to point C thence in a southerly direction for 26 metres to point D (Grid reference SN 740061).

Length of the path = 106 metres

Width of the path = 1.5 metres
